Removal and Deportation Proceedings are Immigration Court Proceedings before what is known as the Executive Office of Immigration Review or EOIR where a noncitizen of the United States is facing expulsion from the United States for committing an Immigration law violation.

Noncitizens present in the United States with legal immigration status. For Legal Permanent Residents also known as Green Card Holders or noncitizens holding any temporary immigration status, these noncitizens are accused for committing a criminal or fraudulent act in violation of immigration law that subjects the noncitizen to Removal and Deportation proceedings which is the process to take away the green card or any other immigration status by allowing the Department of Homeland Security to seek a deportation order from an immigration judge to expel the noncitizen for the immigration law violation.

Noncitizens with no status. For noncitizens of the United States who hold no immigration status they are subject to removal and deportation proceedings which is the expulsion process for simply being present in the United States with no status. This could be because the noncitizen entered the United States without authorization which could be a result of entering without being inspected and admitted by an immigration officer or entering without a valid visa or travel document. This could also be because the noncitizen once possessed a valid temporary immigration status, but then let the status expire or committed an act in violation of immigration law that exposed the noncitizen to losing the temporary immigration status. Simply being present in the United States without status allows the Department of Homeland Security to seek a removal order from an immigration judge to expel the noncitizen from the United States.

Commencement of Removal and Deportation Proceedings. In either scenario, the noncitizen is likely detained and an accusatory document known as a Notice to Appear or NTA is issued by the Department of Homeland Security providing the noncitizen notice of the factual allegations of the violation and the legal basis for commencing the removal proceeding.
