Parole in Place: Keeping Families United and Supporting Our Military

Family on Digital Tablet

Parole in Place Overview

Parole in Place (PIP) is a discretionary program allowing certain family members of U.S. citizens and lawful permanent residents to remain in the United States and adjust their status without having to leave the country. This program is particularly relevant for spouses, children, and parents of U.S. military members or veterans. Additionally, under the Keeping Families Together initiative, other individuals who meet specific criteria may also qualify for PIP.

At Barrera Legal Group, we understand the importance of family unity and the unique sacrifices made by our military families. The Parole in Place (PIP) program offers a crucial opportunity for certain undocumented immigrants to secure temporary relief from deportation and take steps toward lawful status—all without having to leave the United States.

PIP is available in two key forms: Military PIP and Keeping Families Together PIP. Both programs are designed to allow eligible family members to apply for legal permanent resident status (a green card) through the adjustment of status process without leaving the United States. This pathway is essential for avoiding the unlawful presence bars that could be triggered if a family member were to leave the U.S. for consular processing abroad.

Below, we outline the eligibility criteria, benefits, and application process for each program.

Eligibility for Parole in Place

  • Military Service: Parole in Place is most commonly granted to family members of U.S. military personnel, veterans, and recruits. This can include spouses, children, and parents who have overstayed their visas or entered the country unlawfully.

  • Keeping Families Together Program: Announced in June 2024, this initiative extends the benefits of Parole in Place to other categories of immigrants who have demonstrated significant family ties in the U.S. and meet additional eligibility criteria

Benefits of Parole in Place

  • Avoid Deportation: Individuals granted PIP can avoid deportation and remain in the U.S. with their families.

  • Path to Legalization: Recipients of PIP may apply for adjustment of status, leading to a green card without the need to leave the U.S.
